Nobody thought about planning permission until the house went on the market and the buyer’s solicitor started asking awkward questions. Or a letter arrived from the council. We hear versions of this story constantly in Camden, Islington, Haringey, Barnet and Enfield.

There’s a legal route for it. Not a loophole. An actual, proper application.

The retrospective application

Section 73A of the Town and Country Planning Act 1990 lets you apply for permission after the work is done. Worth knowing before you panic: building without permission isn’t a crime. Ignoring an enforcement notice is, but simply having an unpermitted extension won’t get you prosecuted.
The council assesses a retrospective application the same way it would any other. Same policies, same tests. They can’t refuse it out of spite because you jumped the gun, and the fact that it’s already standing won’t buy you any goodwill either. In our experience a decent proportion of these schemes would have sailed through if someone had just applied at the time.

If it’s refused, though, the council can serve an enforcement notice requiring you to alter or demolish. And since the Localism Act 2011 you can’t have it both ways: apply retrospectively and you give up the matching ground of appeal against any later notice. So the order in which you do things matters. Timing matters too.

The old four-year immunity rule for building works became ten years in April 2024, but work finished before then may still be protected under the old rule, in which case a Lawful Development Certificate is usually the smarter route than a Section 73A application.
